1. Overview

Welcome to Scout4.me, a mobile application (the "App" or the "Service") provided by MB Late nights, MB ("we," "our," "us"), a company registered and operating under the laws of Lithuania.

By accessing or using Scout4.me (available globally on iOS and Android), you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy. These Terms apply to all users of the App, including those who create accounts and use our product tracking tools.

If you do not agree to all the terms herein, do not use or access Scout4.me.

We reserve the right to update these Terms from time to time. Your continued use of the App after any changes constitutes acceptance of the revised Terms. Please review these Terms periodically for any updates.

2. Service Description

Scout4.me provides users with a tool to track products and listings on third-party websites by inputting those websites into the App. The App notifies users of price changes, stock availability, and other related updates.

Important: We are not responsible or liable for the content, availability, accuracy, or legality of any third-party websites or listings you choose to monitor via the App. Your use of the App is at your own risk, and you alone are responsible for the websites you choose to track.

3. Eligibility and Account Registration

• You must be at least 18 years old or the age of majority in your jurisdiction to use Scout4.me.
• You agree to provide accurate, current, and complete information when creating an account, including your email address.
• You are responsible for maintaining the confidentiality of your account password and all activity under your account.
• You agree to immediately notify us of any unauthorized use of your account.
• The App stores your password in an encrypted format.

4. User Obligations and Prohibited Uses

By using Scout4.me, you agree not to:

• Use the Service for any unlawful or unauthorized purpose or to violate applicable laws.
• Input or track websites or content that violate any third-party rights, including intellectual property rights.
• Transmit malicious code, viruses, or other harmful components through the App.
• Exploit or abuse the Service in any manner, including circumventing security features.
• Interfere with or disrupt the operation of the Service.

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, for violations or suspected misuse.

5. Data Collection and Privacy

We collect and process personal data in accordance with our Privacy Policy. The personal data we collect includes:

• Email Address – for account creation and login.
• Encrypted Password – for account security.
• Device IP Address – used only for regional personalization and not stored long-term.
• User-Provided Content – such as product or listing URLs entered into the app, which are stored to deliver our core tracking functionality. These URLs are associated with your account while it is active.

We do not use cookies in the App. Upon account deletion, all personal data, including your email, encrypted password, and associations to stored URLs, are permanently removed. However, non-personal, technical metadata (such as selectors or structural patterns related to URLs) may be retained in anonymized form to ensure continued service performance and functionality across the platform. This data cannot be linked back to you or any specific user.

We comply with all applicable data protection laws, including the General Data Protection Regulation (GDPR) for users in the European Union and, where applicable, the California Consumer Privacy Act (CCPA) for U.S. users.

6. In-App Purchases and Subscriptions

Scout4.me offers free access to basic features. However, certain advanced features may be available through in-app purchases or subscription plans.

All purchases are processed through third-party payment platforms (e.g., Apple App Store, Google Play Store) and are subject to their terms and conditions.

Refunds: All transactions are subject to the refund policies of the respective app stores (Apple and Google). We do not offer direct refunds.

7. Disclaimer of Warranties and Limitation of Liability

Scout4.me and Late nights, MB provide the Service "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted, secure, or error-free operation of the App.

To the fullest extent permitted by law, Late nights, MB shall not be liable for any damages arising from your use or inability to use the Service, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages. In no event shall our liability exceed the amount you paid to us, if any, for the use of the Service.

8. Intellectual Property

All intellectual property rights in the App, including its design, content, and features, are owned by Late nights, MB or licensed to us.

You may not copy, modify, distribute, sell, or exploit any part of the Service without our prior written consent.

9. Termination

You may delete your account at any time through the App. Upon account deletion, your data will be permanently erased from our systems.

We reserve the right to suspend or terminate your access to Scout4.me at our sole discretion, especially if you breach these Terms or misuse the Service.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Lithuania and applicable European Union regulations.

For disputes that cannot be resolved amicably between the parties, the courts of Lithuania will have exclusive jurisdiction. However, nothing in these Terms will limit your rights under mandatory consumer protection laws applicable in your jurisdiction, which may include the right to bring claims in the local courts of your country.

11. Third-Party Services

We may use third-party services to operate the App and process data (e.g., Firebase for analytics). By using the App, you consent to our use of such third-party services.

Limitation of Liability for Third-Party Services: We are not responsible for any third-party services or their performance, and you agree to hold us harmless for any damages resulting from the use of third-party services.

12. User-Generated Content

While you are not submitting any content in the App, you are responsible for the websites you choose to track. You agree not to track or use any website that infringes upon third-party rights.

13. Indemnification

You agree to indemnify, defend, and hold harmless Late nights, MB and its affiliates, officers, directors, employees, agents, and licensors from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App or your breach of these Terms.

By creating an account or using Scout4.me, you expressly consent to these Terms of Service and our Privacy Policy.
